3. Definitions

Product: a movable item offered on the Website and intended for sale on the Website, including goods with digital elements.

Parties: the Seller and the Customer together

Consumer contract: a contract in which one of the parties qualifies as a consumer.

Website: www.bazzikoshop.hu.

Contract: the sales contract concluded between the Seller and the Customer through the Website and by email.

Customer: a natural person acting outside the scope of their profession, independent occupation or business activity (consumer) who makes an offer to purchase through the Website for the conclusion of a contract.

4. GENERAL INFORMATION

For Product orders placed electronically on the Website, a distance contract is concluded between the Seller and the Customer under Government Decree 45/2014. (II. 26.) on the detailed rules of contracts between consumers and businesses.

The content of the Contract concluded between the Customer and the Seller is determined jointly by the individual conditions established between the Customer and the Seller during the purchase process (the confirmation email sent about the Product purchased by the Customer and the details of the order) and these General Terms and Conditions (hereinafter: "ÁSZF").

Technical information required for using the Website that is not contained in this ÁSZF is available on other pages of the Website.

The Contract is concluded in Hungarian or in English, depending on the language chosen by the Customer.

An order placed through the Website does not qualify as a written declaration but as a legal declaration made by implied conduct. Consequently, the contract concluded electronically between the Customer and the Seller does not qualify as a written contract; it is not filed by the Seller and therefore cannot be accessed or viewed afterwards.

Products can be purchased exclusively online, through the Website. The Seller does not offer the possibility of placing orders by email, by post or by phone.

By implied conduct (for example, by ticking a checkbox), the Customer acknowledges and accepts the provisions of this ÁSZF and the individual conditions relating to the purchase of the Product.

5. PURCHASE CONDITIONS

The Customer may choose from the Products displayed on the Website. Browsing and purchasing on the Website do not require registration.

A user account can be created by clicking the login icon and then the "New customer? Create account" link. Registration is available on the Website but is not mandatory.

Deletion of registration

The Customer is entitled to request the deletion of their registration from the Seller by email. In the event of deletion, the user data are removed from the system immediately after the deletion. However, this does not affect the retention of data and documents (invoices) related to orders already placed, and does not result in the deletion of these data. After removal, the data can no longer be restored.

The Customer is solely responsible for keeping the user access data (in particular the password) confidential. If the Customer becomes aware that an unauthorised third party may have obtained the password provided during registration, the Customer must change the password without delay, and if it can be assumed that the third party is misusing the password in any way, the Customer must notify the Seller.

The Customer undertakes to update the personal data provided during registration as necessary so that they are current, complete and accurate.

5.1. Ordering process

5.1.1. Getting to know and selecting Products, display of Products

The Customer can browse the Products on the Website. Clicking on a category name displays the list of Products it contains. By clicking on the name or photo of a Product, the Customer can find information about the essential properties, detailed characteristics and price of the Product.

When displaying images, photographs and product photos on the Website, the Seller continuously strives to ensure that the photographs on the Website give as true-to-life an impression as possible. Nevertheless, the colours of images, photographs and product photos may appear differently to the human eye than on IT devices. These differences may also depend on the colour resolution and colour display method of the computer or other device you use, and on lighting conditions. The Seller accepts no liability whatsoever for such differences.

5.1.2. Functions of the "cart"

Adding a Product to the cart

If you like a Product, you can select the desired variant and quantity on the Product page and then add it to the virtual cart by clicking the add to cart button.

Viewing the cart

The contents of the cart can be viewed by clicking the cart icon.

Products placed in the cart can be removed from the cart at any time before the order is finally submitted.

The Customer can also change the quantity of Products in the cart.

Starting the ordering process

If everything in the cart is in order, proceed to checkout, where you must enter the personal data required to submit the order in the form displayed, and select the shipping method (home delivery or personal pickup) and the payment method.

Express payment options (for example, Google Pay) may also be available on the checkout page. To use them, the Customer must log in to the system of the relevant provider.

Before finalising your order, please check that the data you have entered are correct. If you notice any data entry errors, be sure to correct them before submitting your order.

The Seller excludes its liability in the event of incorrect or false data being provided, and the person providing incorrect or false data is in all cases liable for the inadequate provision of data, regardless of whether they acted in bad faith or in good faith.

If you wish to change any item or data in the cart before final submission, you may do so at any time before the order is finally submitted.

Once you have made sure that your data are correct and that the contents of the cart correspond to the Products you wish to order, after accepting this ÁSZF and the privacy notice (by ticking the checkbox), you can finally submit your order to the Seller by clicking the button that finalises the order and indicates an obligation to pay, which creates a payment obligation for the Customer. In the case of card payment, payment takes place on the checkout page, in the secure system of the financial service provider contracted with the Seller. In the case of bank transfer, the Seller sends the Customer the details required for payment by email.

5.2. Important information about Product prices

The purchase prices of the Products displayed on the Website are shown including value added tax and other public charges (gross), in accordance with the VAT rate of the Product and the rules applicable to the Seller's tax status. The purchase price shown next to the Products does not include the cost of delivery. Product prices are shown in Hungarian forints (HUF). The final amount payable, as shown in the order summary and the confirmation email, includes all costs, including the shipping fee.

The Seller may periodically offer price discounts on the prices of its products. In the case of a general price reduction, the discounted price is clearly indicated on the Product page. However, if the discount is conditional on redeeming a coupon (for example, exclusive discounts), the discounted price becomes visible during the ordering process, after the coupon code has been entered.

5.2.1. Incorrect price

The Seller exercises the utmost care when displaying the prices and descriptions of the Products. It may nevertheless happen that, without or contrary to its contractual intention, the Seller displays a price (promotional price) that differs significantly from the usual market price of the Product and/or displays an unrealistic price due to an IT device or software error.

An obviously incorrect price may be any of the following three cases:

  • the Seller displays a price of HUF 0 for one or more Products,
  • the Seller displays a discounted price for one or more Products that is not reduced in line with the actual extent of the discount,
  • the Seller erroneously displays a price for one or more Products, without any actual intention to reduce the price, that is lower than even the discounted market price level.

In such cases, the Seller is entitled to:

a) not accept (reject) your offer made with content that differs from the Seller's contractual intention (at an unrealistically low price)

AND

b) at its discretion, invite you to make an offer at a price that corresponds to its actual contractual intention (you are not obliged to place a new order with us at this new price),

OR

c) treat the offer process started at the incorrect price as closed without result, in which case the contract is not concluded.

We consider it important to emphasise that, when assessing commercial practices, the conduct of a consumer who is reasonably well informed and acts with the attention and care generally expected in the given situation must be taken as the basis.

The Seller therefore assumes that, when ordering, the Customer acts as can be expected of an informed consumer, that is, the Customer is aware of the properties, characteristics and market price level of the Product they wish to order, and therefore also of whether the price displayed by the Seller for the Product is obviously too low.

Product availability

On the Website, Products may be either in stock or not in stock.

5.3. Order confirmation process on the Website

After the Customer has submitted the order to the Seller on the Website, the Customer will receive two emails from us.

The first email is an automatic confirmation email informing you that your order has been received by the system. This is a technical system message that does not contain the data provided by the Customer, only the order identifier.

The second email (no longer an automatic, technical system message) contains the Seller's contractual declaration (that is, the declaration accepting the Customer's offer/order), which confirms whether the order can be fulfilled no later than 5 business days from the time the Customer submitted the order. If the response of the manufacturer or distributor is not received within this period, the Seller informs the Customer of this by email. As the Seller also offers Products on the Website that are not in stock and must be procured, the Customer may receive two types of second email.

In the case of a Product in stock, the Seller's second email contains the personal data provided by the Customer during the order, the details of the ordered Product, the order identifier, the date of the order, the list and quantity of the ordered Products, the price of the Product, the shipping cost and the final amount payable, as well as confirmation that the order can be fulfilled and, accordingly, the expected delivery time. The offer acceptance email constitutes the Seller's acceptance of the offer made by the Customer, with which the contract between the Customer and the Seller is concluded. The exact delivery deadline is in all cases contained in the Seller's second confirmation.

In the case of Products not in stock, the Seller requests information from the manufacturer about whether the Product can be ordered. If the Product is available, the Seller informs the Customer of this in the second email, which already contains the personal data provided during the order, the details of the ordered Product, the order identifier, the date of the order, the list and quantity of the ordered Products, the price of the Product, the shipping cost and the final amount payable, as well as confirmation that the order can be fulfilled and, accordingly, the expected delivery time. The offer acceptance email sent by the Seller constitutes the Seller's acceptance of the offer made by the Customer, with which the contract between the Customer and the Seller is concluded. The exact delivery deadline is in all cases contained in the Seller's second confirmation. If the Product has been discontinued or cannot be procured for any other reason, the Seller informs the Customer in the second email that the order cannot be fulfilled and that no contract is concluded between the Parties.

If you find that the confirmation contains your data incorrectly, you must notify the Seller of this by email without delay, providing your correct data at the same time.

If the confirmation email, which also concludes the contract, does not arrive in your email account within 5 business days, please contact us, as your order may not have reached the Seller's system for technical reasons.

5.4. Conclusion of the contract, binding nature of the offer

5.4.1. Binding nature of the offer

The Customer is released from the binding nature of the offer or from the contractual obligation if they do not receive the email from the Seller confirming receipt of the order without delay, and in any case within 48 hours at the latest.

The order and its confirmation are deemed to have been received by the Seller or the Customer when they become accessible to the addressee.

If the confirmation does not arrive in time because the Customer provided an incorrect email address during the ordering process, or because the Customer cannot receive messages due to the storage space of their account being full, the Seller excludes its liability for the failure of the Customer's order and for the contract not being concluded.

If the Customer has already sent the order to the Seller and notices an error in the data contained in the confirmation email, the Customer must notify the Seller within 1 day in order to avoid the fulfilment of unwanted orders or orders with incorrect data.

5.4.2. Conclusion of the contract

The offer acceptance email defined in section 5.3 constitutes the Seller's acceptance of the offer (order) made by the Customer, with which the contract between the Customer and the Seller is concluded at the time when the Seller's email containing its contractual declaration (offer acceptance email) becomes accessible in the Customer's email system.

The contract for the sale of a Product concluded online between the Customer and the Seller qualifies as a sales contract concluded electronically. Under the sales contract, the Seller is obliged to transfer ownership of the item, and the Customer is obliged to pay the purchase price and take delivery of the item.

5.5. Invoice

The Seller issues an electronic invoice for the purchase and sends the invoice to the Customer by email.

5.6. Payment methods

The Customer can pay the purchase price of the selected Products by card, securely in the system of the financial service provider contracted with the Seller, or by bank transfer. In the case of bank transfer, the Seller sends the Customer the details required for payment by email. The purchase price must be transferred within 3 business days of placing the order. If the purchase price is not received in the Seller's bank account within this period, the Seller is entitled to cancel the order and informs the Customer of this by email.

With regard to the payment methods it accepts, the Seller does not apply different conditions to the payment transaction for reasons related to the Customer's nationality, place of residence or place of establishment, the location of the payment account, the place of establishment of the payment service provider or the place of issue of the cashless payment instrument within the Union.

5.7. Shipping conditions

Detailed information on the currently available shipping methods, their fees and other conditions can be found in the Shipping policy available on the Website. Here in the ÁSZF, we provide only general information on shipping conditions.

For home delivery, please provide a delivery address where you are available during the day.

For home delivery, the Seller delivers the Product to the Customer through a courier service. When ordering, the Customer may also choose personal pickup at the Seller's Budapest office (1061 Budapest, Andrássy út 45. 2. em. 1. ajtó, Monday to Friday, 10:00 to 17:00). In the case of personal pickup, the Seller notifies the Customer by email or phone as soon as the Product is ready for pickup, and keeps the Product for 10 business days from the notification. The fee for shipping the Product to the Seller's office, as set out in the Shipping policy, is charged in the case of personal pickup as well.

If the Customer is not present at the given delivery address at the specified time and delivery of the parcel fails, the courier leaves a notification via one of the contact details provided. Using the number on the notification, the Customer can provide or arrange a new delivery address and time with the courier service. The courier service makes 1 further attempt to deliver the ordered Products.

The courier service therefore attempts delivery twice in total; however, if the 2nd delivery also fails for reasons attributable to the Customer, the Product is returned to the Seller.

The courier service delivers products in stock in Hungary during working hours (between 8:00 and 17:00). The second delivery attempt takes place on the following business day, unless the Customer has specified a different time for the new delivery. Its fee is included in the shipping cost already paid.

The Seller procures the Products by manufacturer; therefore, the Products of an order containing Products from more than one manufacturer may arrive in separate parcels per manufacturer and at different times. The Seller delivers Products ordered from one manufacturer at the same time and does not undertake partial deliveries within them.

Where possible, when receiving the Product(s), the Customer must check whether the packaging is undamaged. If you notice damage to the packaging and/or the Product(s), ask the courier to draw up a report and/or contact us without delay.

5.7.1. Delivery deadline

The Seller procures the Products on the Website to order, from the manufacturer or distributor; therefore, the delivery times shown on the Website are indicative. The Seller informs the Customer of the expected delivery time in the second email defined in section 5.3. Unless otherwise agreed, the Seller makes the Product available to the Customer (delivers it or makes it available for personal pickup) within thirty days of the conclusion of the contract.

The specific delivery deadline is in all cases contained in the confirmation sent by the Seller or the courier.

The Seller hands over the Customer's order to the courier service as soon as possible. The Seller and/or the courier company notifies the Customer of the delivery date in advance by email and/or SMS.

In the event of delay by the Seller, a Customer who qualifies as a consumer is entitled to set an additional deadline. If the Seller does not perform within the additional deadline, the Consumer is entitled to withdraw from the contract.

The Customer is entitled to withdraw from the contract without setting an additional deadline if

a) the Seller has refused to perform the contract

OR

b) according to the agreement of the Parties or due to the recognisable purpose of the service, the contract should have been performed at the specified time of performance, and not at any other time.

5.7.2. Transfer of risk

The Seller undertakes to deliver the Product(s) to the Customer, and the risk of loss or damage passes to the Customer when the Customer or a third party designated by the Customer takes possession of the Product(s). The risk passes to the Customer upon handover to the carrier if the carrier was engaged by the Customer, provided that the carrier was not recommended by the Seller.

6. INFORMATION ON THE RIGHT OF WITHDRAWAL AND THE RULES FOR EXERCISING IT

The rights listed in this section belong to a Customer who qualifies as a consumer (hereinafter: "Consumer"); companies, institutions, etc. (legal persons) cannot exercise the right of withdrawal described below (nor can a business, that is, a person acting within the scope of their profession, independent occupation or business activity).

In the case of a CONTRACT FOR THE SALE OF A PRODUCT, the Consumer is entitled to withdraw from the contract without giving any reason within fourteen (14) days from the day on which the following is received by the Consumer or by a third party designated by the Consumer, other than the carrier:

a) the Product,

b) where several Products are supplied, the last Product supplied,

c) in the case of a Product consisting of several lots or pieces, the last lot or piece supplied,

d) where the Product is to be supplied regularly within a specified period, the first supply.

The Consumer may also exercise the right of withdrawal in the period between the day the contract is concluded and the day the Product is received.

If the Consumer wishes to exercise the right of withdrawal, the Consumer must send the Seller a clear statement expressing the intention to withdraw (for example, a letter sent by post or electronically) using the contact details given in section 1 of this ÁSZF. For this purpose, the Consumer may use the model withdrawal form, which is available on the Website in a downloadable format. It is important that, if the Consumer does not use the model withdrawal form, the Consumer makes a clear statement of withdrawal to the Seller in writing, by email or by post. The Consumer exercises the right of withdrawal in time if the withdrawal statement is sent to the Seller before the deadline indicated above expires.

The burden of proving that the right of withdrawal was exercised in accordance with the provisions of this section lies with the Consumer.

In both cases, the Seller confirms receipt of the Consumer's withdrawal statement by email without delay.

In the case of withdrawal in writing, it shall be deemed to have been exercised in time if the Consumer sends the relevant statement to the Seller within 14 calendar days (including on the 14th calendar day).

For the purpose of calculating the deadline, the Seller takes into account the date of posting in the case of notification by post, and the time the email was sent in the case of notification by email. The Consumer should send the letter by registered post so that the date of posting can be credibly proven.

In the event of withdrawal, the Consumer must return the ordered Product to the Seller at the address specified in section 1 (by post or by courier) without undue delay, and in any case no later than 14 days from the communication of the withdrawal statement. The deadline is deemed to have been met if the Consumer sends the Product (posts it or hands it over to the courier ordered by the Consumer) before the 14-day deadline expires.

The cost of returning the Product to the Seller's address is borne by the Consumer, unless the Seller has agreed to bear these costs. However, the Seller does not undertake to organise or carry out the return shipment, nor does it take over the cost of returning the Product from the Consumer.

The Seller is unable to accept parcels returned cash on delivery. Apart from the cost of returning the Product, the Consumer bears no other costs in connection with the withdrawal.

If the Consumer withdraws from the contract, the Seller refunds the full amount paid by the Consumer without delay, and in any case no later than 14 days from receipt of the Consumer's withdrawal statement, including, in addition to the price of the Product, the transport (delivery) cost, except for any additional costs incurred because the Consumer chose a method of transport other than the least expensive standard method of transport offered by the Seller.

The Seller is entitled to withhold the refund until it has received the Product back or until the Consumer has credibly proven that it has been returned, whichever is earlier.

For the refund, the Seller uses the same payment method as the one used in the original transaction, unless the Consumer expressly consents to the use of another payment method; the Consumer bears no additional costs as a result of this refund method. If you agree to the refund being made by bank transfer, please provide your bank account number in your withdrawal statement.

The Consumer may be held liable for any reduction in the value of the Product only if it results from use beyond what is necessary to establish the nature, characteristics and functioning of the Product. The Seller may therefore claim compensation for the reduction in value resulting from use beyond what is necessary to establish the nature, characteristics and functioning of the Product and, if the performance of a service contract was started before the deadline at the express request of the Consumer and the Consumer exercises the right of termination, for its reasonable costs.

However, in certain cases the Consumer is not entitled to the right of withdrawal:

  • in the case of a Product that is not prefabricated and was made according to the consumer's instructions or at the consumer's express request, or in the case of a product that was clearly personalised for the consumer,
  • in the case of a sealed Product which, for health protection or hygiene reasons, cannot be returned once unsealed after delivery,
  • in the case of a product which, by its nature, becomes inseparably mixed with other products after delivery,
  • in the case of an alcoholic beverage whose actual value depends on market fluctuations that cannot be influenced by the Seller, and whose price was agreed by the parties when the sales contract was concluded, but where the contract is to be performed only after the thirtieth day following its conclusion,
  • in the case of a contract for work where the Seller visits the consumer at the consumer's express request to carry out urgent repair or maintenance work,
  • in the case of the sale of a sealed audio or video recording or a copy of computer software, if the consumer has opened the packaging after delivery,
  • in the case of newspapers, periodicals and magazines, with the exception of subscription contracts,
  • in the case of contracts concluded at a public auction,
  • in the case of contracts for the provision of accommodation other than for residential purposes, transport, car rental, catering or services related to leisure activities, if a specific date or period of performance has been set in the contract,
  • in the case of digital content not supplied on a tangible medium, if the Seller has begun performance with the consumer's express prior consent and the Consumer, at the same time as giving this consent, has acknowledged that they will lose the right of withdrawal once performance has begun.

7. COMPLAINT HANDLING

7.1. MEANS OF ENFORCING RIGHTS

The Customer may lodge a complaint with the Seller regarding the conduct, activity or omission of the Seller or of any person acting on behalf of or for the benefit of the Seller that is directly related to the distribution or sale of the Product(s) to the Customer.

The Customer may lodge a complaint orally or in writing.

The Customer may submit consumer complaints relating to the Product or to the Seller's sales activity primarily and directly through the contact details specified in section 1.

7.1.1. Oral complaint

The Seller must examine a complaint communicated by phone immediately and, if possible, remedy it as necessary. If the Customer does not agree with the handling of the complaint or if immediate investigation of the complaint is not possible, the Seller draws up a record of the complaint.

In the case of an oral complaint communicated by phone or by means of another electronic communications service, the Seller sends the Customer a copy of the record at the latest together with the substantive reply, and in any case within 30 days.

The Seller must keep a copy of the record of the complaint for three years from the date it was taken and present it to the supervisory authorities.

The Seller assigns a unique identifier to complaints recorded by phone or by other means of communication, which makes it easier to retrieve the complaint later.

In all other respects, when processing an oral complaint, the Seller proceeds according to the rules applicable to written complaints.

7.1.2. Written complaint

The Seller replies substantively to a complaint received in writing within 30 days and arranges for the reply to be communicated.

If the complaint is rejected, the Seller informs the Customer of the reason for the rejection. If the complaint is rejected, the Seller must inform the Customer in writing which authority or conciliation board the Customer may approach with the complaint, depending on its nature. The information must also include the registered office, telephone and internet contact details and postal address of the competent authority or of the conciliation board competent for the Customer's place of residence or stay. The information must also state whether the Seller uses the conciliation board procedure to settle the consumer dispute.

7.2. Other means of enforcing rights

If a consumer dispute that may arise between the Seller and the Customer is not settled during negotiations with the Seller, a Customer who qualifies as a consumer may turn to the conciliation board competent for their place of residence or stay and initiate the board's procedure, or may also turn to the conciliation board competent for the Seller's registered office. In addition, the following means of enforcing rights are available to the Customer:

  • Conciliation board procedure
  • Complaint to the consumer protection authority
  • Court proceedings

7.2.1. Complaint to the consumer protection authority

If the Customer detects a violation of their consumer rights, they may lodge a complaint with the consumer protection authority competent for their place of residence. After assessing the complaint, the authority decides whether to conduct consumer protection proceedings. The consumer protection authority acts upon request or ex officio, examining the Seller's market conduct from a consumer protection perspective. However, the Customer's individual case is resolved by the conciliation board, that is, in this case the consumer protection authority transfers the applicant's case to the conciliation board.

The government offices have been designated as the general consumer protection authority by the relevant legislation. Contact details of the government offices: https://www.kormanyhivatal.hu/hu/elerhetosegek

7.2.2. Initiating a conciliation board procedure

If the Seller rejects the complaint of a Customer who qualifies as a consumer, the Customer is entitled to turn to the Conciliation Board competent for their place of residence or stay, or to the Conciliation Board indicated by the Customer in the application. A condition for initiating the Conciliation Board procedure is that the consumer has attempted to settle the dispute directly with the business concerned.

Unless the consumer requests a hearing in person, the Conciliation Board holds the hearing online, without personal presence, by means of an electronic device ensuring simultaneous transmission of sound and image (hereinafter: online hearing).

The Seller is subject to an obligation to cooperate in the conciliation board procedure. This means that, upon the invitation of the Conciliation Board, the business must send its response to the conciliation board within the deadline.

Except where Regulation (EU) No 524/2013 of the European Parliament and of the Council of 21 May 2013 on online dispute resolution for consumer disputes and amending Regulation (EC) No 2006/2004 and Directive 2009/22/EC applies, the business must ensure the participation at the hearing of a person authorised to reach a settlement. At an online hearing, the representative of the business authorised to reach a settlement must participate online. If the consumer requests a hearing in person, the representative of the business authorised to reach a settlement must participate in the hearing at least online.

The Conciliation Board issues a decision containing an obligation if the Seller has not made a declaration of submission, but the application is well founded and the claim the consumer wishes to enforce does not exceed two hundred thousand forints, either in the application or at the time the decision containing the obligation is issued.

This means that if the Seller does not comply with the decision of the Conciliation Board containing an obligation within the deadline for performance, the consumer may request the court to append an enforcement clause to the decision of the conciliation board.

In the case of a decision containing an obligation, the costs of the procedure are borne entirely by the Seller, while if the consumer's application is rejected, the parties bear their own costs, that is, the consumer does not have to reimburse the Seller's costs under any circumstances.

More information about the Conciliation Boards is available here: https://www.bekeltetes.hu

Under the Consumer Protection Act, for the purposes of the Conciliation Board procedure, a civil society organisation as defined by a separate act, a church legal entity, a condominium or a housing cooperative acting for purposes outside its independent occupation and economic activity, which buys, orders, receives or uses goods or is the recipient of commercial communication or an offer relating to goods, also qualifies as a consumer.

The Conciliation Board is entitled to check and examine whether consumer status exists. The procedural rules are governed by the rules described under the Conciliation Board.

7.2.3. Initiating court proceedings

If the Customer does not turn to a conciliation board, or if the procedure was unsuccessful, the Customer may turn to the court to settle the dispute in civil proceedings under the provisions of Act V of 2013 on the Civil Code and Act CXXX of 2016 on the Code of Civil Procedure. The lawsuit must be initiated by a statement of claim. All documents, or copies thereof, whose content the Customer relies on as evidence must be attached to the statement of claim.

The statement of claim must contain the following information:

  • the court proceeding in the case;
  • the names, places of residence and procedural status of the parties and their representatives;
  • the right to be enforced, with a presentation of the underlying facts and the evidence supporting them;
  • the data from which the jurisdiction and competence of the court can be established;
  • a specific request for a decision by the court.

8. INFORMATION ON WARRANTY AND GUARANTEE RIGHTS

Defective performance occurs when the Seller's performance (the Product) does not meet the quality requirements set out in the Contract or by law.

It is important to note that the Seller has not performed defectively if you knew or should have known of the defect at the time the contract was concluded (for example, in the case of a discounted Product of reduced quality).

The Seller's performance (the Product or other related services) qualifies as being in conformity with the contract if the following conditions are met:

a) it must correspond to the description, quantity, quality and type set out in the contract, and must have the functionality, compatibility, interoperability and other characteristics specified in the contract;

b) it must be suitable for any purpose specified by the consumer which the consumer made known to the Seller at the latest when the contract was concluded and which the Seller accepted;

c) it must have all the accessories and instructions for use specified in the contract, including commissioning instructions, installation instructions and customer support; and

d) it must provide the updates specified in the contract.

A further condition for performance in conformity with the contract is that the Product or other service of the Seller:

(i) is suitable for the purposes prescribed for services of the same type by law, technical standard or, in the absence of a technical standard, the applicable code of conduct;

(ii) has the quantity, quality, performance and other characteristics, in particular with regard to functionality, compatibility, accessibility, continuity and safety, that are usual for services of the same type and that the consumer can reasonably expect, taking into account any public statement made by the Seller, its representative or another person in the chain of transactions about the specific characteristics of the service, in particular in advertising or on labelling;

(iii) has the accessories and instructions that the consumer can reasonably expect, including packaging and commissioning instructions; and

(iv) corresponds to the characteristics and description of the service presented by the Seller as a sample or model, or made available as a trial version, before the contract was concluded.

Important: the Seller's service does not have to correspond to the public statement referred to in point (ii) if the Seller proves that

a) it was not aware, and could not reasonably have been aware, of the public statement;

b) the public statement had been appropriately corrected by the time the contract was concluded; or

c) the public statement could not have influenced the consumer's decision to conclude the contract.

Defective performance in the case of a contract for the sale of goods

The Seller performs defectively if the defect of the Product results from its incorrect installation, provided that

a) the installation forms part of the sales contract and was carried out by the Seller or under the Seller's responsibility; or

b) the installation was to be carried out by the consumer, and the incorrect installation is the consequence of shortcomings in the installation instructions provided by the Seller or, in the case of goods with digital elements, by the supplier of the digital content or digital service.

If, under the sales contract, the goods (Product) are installed by the Seller or the installation is carried out under the Seller's responsibility, performance shall be deemed completed by the Seller when the installation has been completed.

If, in the case of goods with digital elements, the sales contract provides for the continuous supply of the digital content or digital service over a specified period, the Seller is liable for any defect of the goods relating to the digital content or digital service if the defect occurs or becomes apparent

a) in the case of continuous supply for a period not exceeding two years, within two years of delivery of the goods; or

b) in the case of continuous supply for a period exceeding two years, during the entire period of continuous supply.

8.1. Defective performance

A Product is considered defective if it does not meet the quality requirements in force at the time it was placed on the market or if it does not have the characteristics stated in the description provided by the manufacturer.

There is no defective performance if the entitled party knew or should have known of the defect at the time the contract was concluded.

In the case of a consumer contract, until proven otherwise, it shall be presumed that a defect recognised by the Customer within one year of performance already existed at the time of performance, unless this presumption is incompatible with the nature of the item or the nature of the defect.

8.1.1. Warranty for defects (kellékszavatosság)

In the event of defective performance by the Seller, the Customer may assert a warranty claim against the Seller in accordance with the rules of the Civil Code and Government Decree 373/2021. (VI.30.). In the case of the purchase of a new product under a consumer contract, the Customer may assert warranty claims within a limitation period of 2 years from the date of receipt, for product defects that already existed at the time the product was handed over. After the two-year limitation period, warranty rights can no longer be enforced.

The Seller sells new Products only.

If the contract is not a consumer contract, the entitled party may assert warranty claims within a limitation period of 1 year from the date of receipt.

The Customer may assert the warranty claim directly against the Seller.

a) Claims that can be asserted under the warranty for defects

The Customer may, at their choice, request repair or replacement, unless fulfilling the claim chosen by the Customer is impossible or would involve disproportionate additional costs for the Seller compared with fulfilling another claim. If the Customer did not or could not request repair or replacement, the Customer may request a proportionate reduction of the consideration or may withdraw from the contract. Withdrawal is not possible because of an insignificant defect.

In the case of a contract between a consumer and a business for the sale of goods qualifying as movable items, the supply of digital content or the provision of digital services, the consumer, when exercising warranty rights, may not repair the defect themselves or have it repaired by another person at the expense of the obligor.

The period available for repair starts when the consumer good is received.

The Customer must make the goods available to the Seller for the purpose of repair or replacement.

The Customer must notify the Seller of the defect without delay after its discovery, and in any case no later than two months from the discovery of the defect.

The Customer may switch from the chosen warranty right to another, but must bear the cost of switching, unless it was justified or the Seller gave cause for it.

If the warranty claim is asserted with regard to a part of the Product that is separable with regard to the indicated defect, the warranty claim shall not be deemed to have been asserted for the other parts of the Product.

The Seller must ensure the taking back of the replaced goods at its own expense. If repair or replacement requires the removal of goods that were installed in accordance with their nature and purpose before the defect became apparent, the obligation to repair or replace includes the removal of the non-conforming goods and the installation of the replacement or repaired goods, or bearing the costs of such removal and installation.

b) Release of the Seller from its warranty obligation

Within 1 year of performance of the contract, there is no condition for asserting a warranty claim other than notifying the defect, if you prove that you purchased the goods from the Seller (by presenting the invoice or a copy of the invoice). In such a case, the Seller is released from the warranty only if it rebuts this presumption, that is, proves that the defect of the goods arose after handover to the Customer. If the Seller can prove that the defect arose for a reason attributable to the Customer, it is not obliged to accept the warranty claim made by the Customer.

If the Seller can prove that the defect arose for a reason attributable to the Customer, it is not obliged to accept the warranty claim made by you. However, after 12 months from performance, you must prove that the defect you recognised already existed at the time of performance.

Warranty rules in the case of a contract for the sale of goods

The Seller may refuse to bring the goods into conformity with the contract if repair or replacement is impossible or would result in disproportionate additional costs for the Seller, taking into account all circumstances, including the value the Product would have if it were free of defects and the seriousness of the breach of contract.

The Customer is also entitled, in proportion to the seriousness of the breach of contract, to request a proportionate reduction of the consideration or to terminate the sales contract if

a) the Seller did not carry out the repair or replacement, or carried it out but did not fulfil, in whole or in part, the following

  • the Seller must ensure the taking back of the replaced Product at its own expense,
  • if repair or replacement requires the removal of a product that was installed in accordance with the nature and purpose of the Product before the defect became apparent, the obligation to repair or replace includes the removal of the non-conforming product and the installation of the replacement or repaired product, or bearing the costs of such removal and installation.

b) or refused to bring the goods into conformity with the contract;

c) a repeated lack of conformity occurred, even though the Seller attempted to bring the goods into conformity with the contract;

d) the lack of conformity is so serious that it justifies an immediate price reduction or the immediate termination of the sales contract; or

e) the Seller has not undertaken to bring the goods into conformity with the contract, or it is clear from the circumstances that the Seller will not bring the goods into conformity within a reasonable time or without significant inconvenience to the Customer.

The reduction of the consideration is proportionate if its amount equals the difference between the value of the goods the Customer would have received in the case of performance in conformity with the contract and the value of the goods actually received by the Customer.

Right to withhold the remaining purchase price

The Customer is entitled to withhold the remaining part of the purchase price, in whole or in part, in proportion to the seriousness of the breach of contract, until the Seller fulfils its obligations relating to conformity of performance and defective performance.

The reasonable period for repair or replacement of the goods must be calculated from the time the Customer notified the Seller of the defect.

Conditions:

Termination of the contract due to defective performance

If the Customer wishes to terminate the sales contract on the grounds of defective performance, the burden of proving that the defect is insignificant lies with the Seller.

The Customer's warranty right to terminate the sales contract may be exercised by a legal declaration addressed to the Seller expressing the decision to terminate.

If the defective performance affects only a certain part of the goods supplied under the sales contract, and the conditions for exercising the right to terminate the contract exist with regard to them, the Customer may terminate the sales contract only with regard to the defective goods, but may also terminate it with regard to any other goods acquired together with them if the Customer cannot reasonably be expected to keep only the goods in conformity with the contract.

If the Customer terminates the sales contract in its entirety or, in accordance with the paragraph above, with regard to part of the goods supplied under the sales contract,

a) the Customer must return the goods concerned to the Seller at the Seller's expense; and

b) the Seller must refund to the Customer without delay the purchase price paid for the goods concerned as soon as it has received the goods or proof of their return.

8.1.2. Product warranty (termékszavatosság)

In the event of a defect of the Product (movable item), a Customer who qualifies as a consumer may, at their choice, withdraw (see section 6) or assert a product warranty claim.

a) Claims that can be asserted under the product warranty

As a product warranty claim, the Customer may only request the repair or replacement of the defective product. When asserting a product warranty claim, the Customer must prove the defect of the product.

The product warranty claim may be asserted within two years from the date the manufacturer placed the product on the market. After this period, this right is lost. After discovering the defect, the consumer must notify the manufacturer of the defect without delay. A defect notified within two months of its discovery shall be deemed to have been notified without delay. The consumer is liable for any damage resulting from late notification.

b) Release of the manufacturer from its product warranty obligation

The manufacturer or distributor is released from its product warranty obligation only if it can prove that:

  • it did not manufacture or place the product on the market in the course of its business activity, or
  • according to the state of science and technology, the defect was not recognisable at the time the product was placed on the market, or
  • the defect of the product results from the application of a law or a mandatory regulatory requirement.

To be released, it is sufficient for the manufacturer or distributor to prove one reason.

8.1.3. Guarantee (jótállás)

In the event of defective performance, the Seller is obliged to provide a guarantee when selling new durable consumer goods listed in Government Decree 151/2003. (IX. 22.) on mandatory warranty for certain durable consumer goods (for example, technical articles, tools, machines), as well as their accessories and components within the scope defined there.

The (material) scope of the decree covers only new Products and applies only to products sold under a consumer contract concluded in the territory of Hungary and listed in the annex to the decree.

Guarantee rights may be asserted only by a Customer who qualifies as a consumer.

The Seller communicates the duration of the guarantee for each Product by means of the data on the guarantee card provided at the latest when the Product is received by the Customer. The guarantee card must be handed over to the consumer no later than the day following the handover of the product.

The Seller is released from its guarantee obligation only if it proves that the cause of the defect arose after performance.

Duration of the guarantee

  • two years for a sale price of at least HUF 10,000 but not exceeding HUF 250,000,
  • three years for a sale price above HUF 250,000.

Failure to meet the above deadlines results in the loss of rights. The part of the repair time during which the Customer cannot use the Product as intended is not included in the guarantee period.

The guarantee period starts on the day the consumer good is handed over to the Customer or, if installation is carried out by the Seller or its agent, on the day of installation. If you have the consumer good installed more than six months after handover, the guarantee period starts on the day the consumer good was handed over.

In the event of replacement (repair) of the Product or a part of the Product, the guarantee period starts again for the replaced (repaired) Product (product part) and for any defect arising as a consequence of the repair.

Claims that can be asserted under the guarantee

In the event of a defect covered by the guarantee, the Customer:

  • may primarily, at their choice, demand repair or replacement, unless fulfilling the chosen guarantee claim is impossible or would result in disproportionate additional costs for the Seller compared with fulfilling the other guarantee claim, taking into account the value the Product would have if it were free of defects, the seriousness of the breach of contract and the harm caused to the Customer by fulfilling the guarantee claim.
  • if the Seller has not undertaken repair or replacement, cannot fulfil this obligation within an appropriate period while protecting the Customer's interests, or if the Customer's interest in repair or replacement has ceased, the Customer may, at their choice, request a proportionate reduction of the purchase price or withdraw from the contract. Withdrawal is not possible because of an insignificant defect.

Defects excluding the assertion of a guarantee claim

A defect is not covered by the guarantee if its cause arose after the Product was handed over to the Customer, for example, if the defect was caused by:

  • incorrect installation (unless the installation was carried out by the Seller or its agent, or the incorrect installation can be traced back to an error in the instructions for use and handling)
  • use contrary to the intended purpose, disregard of the instructions for use and handling,
  • improper storage, improper handling, damage,
  • natural disaster or an act of nature.

Procedure in the case of a guarantee/warranty claim (for a Customer who qualifies as a consumer)

The Customer is not entitled to assert a warranty claim and a product warranty claim for the same defect at the same time, in parallel. However, if a product warranty claim is successfully asserted, the Customer may assert a warranty claim against the manufacturer with regard to the replaced product or repaired part.

The Customer may, at their choice, assert a repair claim directly at the Seller's registered office, at any of its premises, or at the repair service indicated by the Seller on the guarantee card. Guarantee claims can be reported to the Seller through the contact details specified in section 1.

The burden of proving the conclusion of the contract lies with the Customer (by means of the invoice or a copy thereof, a receipt or the guarantee card).

The costs related to fulfilling the warranty/guarantee obligation are borne by the Seller.

The Seller must draw up a record of the warranty or guarantee claim reported to it by the Customer and make a copy of it available to you without delay and in a verifiable manner.

Repair or replacement must be carried out within an appropriate period, taking into account the characteristics of the Product and the purpose the Customer can expect, while protecting the Customer's interests.

If, at the time the warranty or guarantee claim is reported, the Seller cannot state whether the claim reported by the Customer can be fulfilled, it must notify the Customer of its position within five business days in a verifiable manner.

The Seller must keep the record for three years from the date it was drawn up and present it to the supervisory authority.

The Seller strives to carry out repair or replacement within a maximum of fifteen days. If repair or replacement takes longer than fifteen days, the Seller must inform the Customer of the expected duration of the repair or replacement. With the Customer's prior consent, the information is provided electronically or by any other means suitable for providing proof of receipt by the consumer.

If the Product cannot be replaced, the Seller must refund to the Customer the purchase price shown on the invoice or receipt presented by the Customer within eight days. The eight-day deadline starts when the thirty-day deadline set for repair has expired without result.

Other rules on repair in the case of mandatory guarantee

In a contract between a Consumer and a business, the parties may not enter into an agreement that deviates from the provisions of Government Decree 45/2014. (II. 26.) to the detriment of the Consumer.

If, during the guarantee period:

a) during the first repair of the Product, the Seller establishes that the Product cannot be repaired, the Seller must replace the Product within eight days, unless the consumer provides otherwise,

b) the Product fails again after being repaired three times, the Seller must replace the Product within eight days, unless the Customer provides otherwise, or if the Customer does not request a proportionate reduction of the purchase price and, as a consumer, does not wish to repair the consumer good or have it repaired by another person at the Seller's expense,

c) if the repair of the Product is not carried out by the thirtieth day from the communication of the repair claim to the Seller, the Seller must replace the Product within eight days after the thirty-day deadline has expired without result, unless the Customer provides otherwise.

If the consumer good fails for the fourth time, the Customer is entitled to submit a repair claim to the Seller, to request a proportionate reduction of the purchase price from the Seller, or to have the consumer good repaired at the Seller's expense. If the Customer does not exercise these rights or has not made a statement about them, the Seller must replace the consumer good within 8 days; if this is not possible, it must refund the sale price shown on the invoice or receipt to the Customer within 8 days.

Only new parts may be installed in the Product during repair.

If the Seller fulfils its warranty or guarantee obligation in a manner different from the right the Customer wishes to enforce, the reason for this must be given in the record.

In the event of replacement (repair) of the Product or a part of the Product, the guarantee period starts again for the replaced (repaired) Product (product part) and for any defect arising as a consequence of the repair.

Replacement claim within three business days

If the Customer asserts a replacement claim because of a failure of the Product within three business days of purchase (installation), the Seller may not invoke disproportionate additional costs but must replace the Product, provided that the failure prevents its use as intended.

Prohibition of parallel enforcement

However, the Customer is not entitled to assert a warranty claim and a guarantee claim, or a product warranty claim and a guarantee claim, for the same defect at the same time, in parallel.

The guarantee therefore does not affect the enforcement of the Customer's statutory rights, in particular warranty, product warranty and damages rights.

Settlement of disputes

If a dispute arises between the parties that they cannot settle amicably, the Customer may initiate a conciliation board procedure as set out in section 7.2 of the ÁSZF.

The Seller accepts no warranty or liability for damage resulting from faulty or negligent handling after the transfer of risk, excessive use, exposure to influences other than those specified, or any other use of the Products not in accordance with their intended purpose.

Procedure in the case of a guarantee/warranty claim (for a Customer who qualifies as a consumer)

The Seller must draw up a record of the warranty or guarantee claim reported to it by the Customer and make a copy of it available to the Customer without delay and in a verifiable manner.

With your prior consent, the information is provided electronically or by any other means suitable for providing proof of receipt by the consumer.

If the Product cannot be replaced, the Seller must refund to the Customer the purchase price shown on the invoice or receipt presented by the Customer within eight days. The eight-day deadline starts when the thirty-day deadline set for repair has expired without result.

9. OTHER PROVISIONS

9.1. Liability

9.1.1. Use of the Website

The Customer may use the Website solely at their own risk and accepts that the Seller is not liable for damage arising during use, beyond liability for breach of contract caused intentionally or by a criminal offence, or causing harm to life, physical integrity or health.

The Customer must ensure that, when using the Website, they do not infringe the rights of third parties or the law, either directly or indirectly.

The Seller is entitled, but not obliged, to check any content that the Customer may make available while using the Website (for example, comments), and with regard to published content, the Seller is entitled, but not obliged, to look for signs of unlawful activity and accepts no liability for such content.

The Seller's pages may contain links leading to the pages of other businesses. The Seller accepts no liability for the data protection practices and other activities of these providers.

If the Customer notices objectionable content on the Website, please report it to the Seller without delay. If, acting in good faith, the Seller finds the report justified, it is entitled to delete or modify the information without delay.

9.2. Copyright and the consequences of infringement

The Website as a whole, its graphic elements, text and technical solutions, and the elements of the service are protected by copyright or other intellectual property rights. The Seller is the copyright holder or authorised user of all content displayed on the Website and during the provision of services available through the Website, of any copyrighted work and of any other intellectual creation (including, among others, all graphics, photos and other materials, the layout and editing of the Website interface, the software and other solutions used, ideas and implementation).

Saving the content of the Website, or parts of it, to a physical or other data carrier, or printing it, is permitted only for private use or with the prior written consent of the Seller.

Beyond the rights expressly specified in this ÁSZF, neither the use of the Website nor any provision of the ÁSZF grants the Customer any right to use or exploit any trade name or trademark appearing on the Website.

The Seller reserves all rights to all elements of its service, in particular to the domain name, the related subdomains, all other domain names registered by the Seller, their subpages and its online advertising spaces. Any activity aimed at listing, systematising, archiving or uploading (hacking) the Seller's database or reverse engineering its source code is prohibited, unless the Seller has given separate written permission for it.

Without a separate agreement or the use of a service intended for this purpose, it is prohibited to modify, copy, place new data in or overwrite existing data in the Seller's database by bypassing the interface or search engines provided by the Seller.

10. UNILATERAL AMENDMENT OF THE ÁSZF, EXCLUSIONS

The Seller is entitled to amend these General Terms and Conditions unilaterally, after informing the Customer in advance on the Website. The amended provisions become effective with respect to the Customer upon the first use of the Website after their entry into force, and must be applied only to orders and bookings placed after the amendment. The amendment of the ÁSZF has no retroactive effect.
